SUMMARY
When using a panel on the top of the screen, and it set to either "Windows can cover" or "Windows go below", the panel will be obstructing 

STEPS TO REPRODUCE
1. Create an empty panel
2. Move it to the top of the screen
3. Set the panel to either "Windows can cover"
4. In system settings, go to Workspace Behavior -> Desktop effect, make sure that Overview is enabled
5. Open the activities overview

OBSERVED RESULT
The panel is obstructing the screen real estate of the activities overview

EXPECTED RESULT
The panel does not obstruct the screen real estate of the activities overview
