are you refering to some official rules book or just to the windows implementation? Because I consider that "rule" pure nonsense as you can just fill those empty slots with random cards.

I suppose an additional set of "game types" could have this rule changed, but the default is that all spaces must conatin atleast one card before you may deal.... that is what makes spider a "hard to play" game :-)
No, to fill these extra piles and then sort them back does not make it any harder. But I don't care after all.
my wife agrees - enforcing this nonsense rule because other spiders have it doesn't make it less spider. I have yet to see a game that is not winnable with the extra rule, but is in kpat
Been some time since ... :) For example, it is possible to run into situations, where you cannot fill all the empty slots, e.g. because you simply haven't enough cards left (really happened to me once on the windows version). The result is a blocked game where no legal move can be made. Enforcing this rule may result in blocking, especially if a game runs extremely well.
