STEPS TO REPRODUCE
1.  Set panel to "windows can cover"
2. Open Kate

OBSERVED RESULT

Panel does not appear

Sorry, under Wayland, I should have mentioned. 
Does not happen with X11.

I think I should reassign this to Kate, as it seems an issue with it specifically.

So we just leave this buggy? Or is this something the plasma panel can do about it? Do you know the origin of this problem?

I'm afraid the "Windows Can Cover" Panel visibility mode has been removed for Plasma 6 and we aren't planning to bring it back. In its place, we plan to implement an "intelligent auto-hide" or "dodge windows" mode, per Bug 349785. This should hopefully be much better than "Windows Can Cover" ever was, and offer support for its use cases.
