Can you please check if the problem does still exist in KMail 1.9.x?
I will do so, when upgrading next time. That might take a while.
This bug still exists, using Kubuntu Hardy 8.04 with KDE 3.5.9 and KDE 4.1 beta 2 packages, it won't send it with either KDE 3 or KDE 4 version.
Fixed long time ago in 4.4
