SUMMARY
Sometimes, fade works correctly, sometimes it fades to black despite not having checked the "fade to black" box. When I just tried to combine elements differently to get the case where it works correctly, I couldn't manage to get it to work, but it did before. An example project that reproduces this is attached (even though currently it always happens to me).

STEPS TO REPRODUCE
1. Add two clips to the timeline that overlap.
2. Fade one of them in and/or the other one out in that overlapping duration.
3. See preview in the middle or export and look at video.

OBSERVED RESULT
If fadeout of the top clip is used, it fades to black and then the other one suddenly appears, if fadein of the lower clip is used, there is no fade at all and then the lower clip appears as soon as the top one ends.

EXPECTED RESULT
smooth fade from one to the other

Since I'm currently at a pretty simple case, I can use the "dissolve" transition instead, but that cannot replace all cases.

Thanks a lot for your report! This has been recently fixed and the fix will be in 21.08.2 (not yet released).
