Create New submenu isn't greyed out

SUMMARY
The "Create New" submenu is not greyed out in a folder where the user does not have write access.

STEPS TO REPRODUCE
1. Go to a folder where you do not have write access.
2. Right click anywhere not on a file/folder.
3. Notice how the "Create New" submenu isn't greyed out.

OBSERVED RESULT
The "Create New" menu is not greyed out.

EXPECTED RESULT
The "Create New" submenu should be greyed out in an area where the user does not have write access.
